Qualified Eligible Person: the test that comes first.

Commodity trading advisory materials are provided to Qualified Eligible Persons, a status defined by CFTC Regulation 4.7. The definition has two families, and which one applies decides whether a second test applies as well.

Persons who qualify without satisfying the Regulation's Portfolio Requirement include, among others, registered investment advisers, registered broker-dealers, registered commodity trading advisors and commodity pool operators meeting the Regulation's criteria, banks, insurance companies, qualified purchasers, and certain knowledgeable employees of the trading advisor. Non-United States persons, as defined in CFTC Regulation 4.7, may qualify on that basis.

Persons who must satisfy the Portfolio Requirement include, among others, accredited investors, certain trusts, and entities in which each owner or participant is itself a Qualified Eligible Person.

The Portfolio Requirement is satisfied by owning securities and other investments with an aggregate market value of at least $4,000,000; or by having had at least $400,000 on deposit as exchange-specified initial margin and option premiums with a futures commission merchant at any time during the preceding six months; or by a proportionate combination of the two totalling at least one hundred percent.

These summaries are not the complete definition, and the criteria are amended from time to time. The full criteria are set out in CFTC Regulation 4.7(a) as currently in effect, and the Regulation controls over any summary of it, including this one. Golden Capital Partners LLC confirms your status before providing CTA materials or services, and may request supporting documentation for the basis you certify.

How to begin the review.

Open Strategic Intake and choose the objective CTA / Celestial Paragon Zenith for the trading program, or CTA / Corporate hedging & market risk where the question is commodity, energy or currency exposure carried by an operating business rather than a trading program.

State the basis on which you believe you qualify, and whether the Portfolio Requirement applies to that basis. Every request is reviewed before any material is released, and materials are delivered by email to the address you provide.

What the program documents are.

Where the review supports release, the documents that follow are these.

  • Program materials, describing the program, the markets traded, the approach, the risk it accepts and how that risk is measured.
  • The commodity trading advisory agreement, which defines the advisory relationship, the fee structure, the term and how either side ends it.
  • Risk disclosures for futures and options, which are not a formality. They state the specific ways this activity loses money.
  • Trading authorization, the instrument by which the firm is permitted to place orders in your account, and which defines the limits of that permission.

None of these is published, and none of them is delivered from a public address. They are released to an identified person after a review, or they are not released.

This is not the RIA Qualified Client path.

Qualified Eligible Person and Qualified Client are different tests, under different rules, administered for different purposes, leading to different documents and different accounts.

Qualified Eligible Person is a CFTC standard under Regulation 4.7. It governs access to commodity trading advisory materials and program participation. Qualified Client is an investment adviser standard. It governs whether performance-based advisory fees may be charged on an advisory account.

A person can satisfy one and not the other. Satisfying either establishes nothing about the other, and nothing on this website establishes either one. If you came here looking for performance-based tactical advisory, that is the investment advisory side of the firm — the RIA documents path is the right one.

The futures account.

Golden Capital Partners is the advisory side of the arrangement. The futures account itself is carried by a futures commission merchant, which holds the funds, posts margin to the clearing house, executes and clears the trades and issues the statements. TradeStation Securities, Inc. provides that account infrastructure and is not affiliated with Golden Capital Partners LLC.

Margin arrives in layers that are easy to confuse. The exchange and its clearing house set one requirement; the broker sets its own customer requirement, and that is a different number with a different source and a different effective date. The Margin Calculator and the TradeStation margin pages set the layers out separately, each with its own source and effective date, rather than blending them into a single figure.

As on the advisory side, identifying and financial information goes directly to the broker on its own application. Do not send it to the firm by email.

The order of operations.

  1. Tell the firm which exposure or objective you are dealing with.
  2. Begin the Qualified Eligible Person review and state the basis you rely on.
  3. The firm reviews it and may request supporting documentation.
  4. Where the review supports it, the firm releases the program materials and risk disclosures.
  5. Read them — the risk disclosures included — and ask what is not clear.
  6. Execute the commodity trading advisory agreement and the trading authorization.
  7. Open the futures account with the broker, complete its own application and fund it.
